If you do not agree to these terms, please do not use the platform. Your continued use signifies your acceptance of these terms and any future updates we may apply.

2. Eligibility

Our platform is intended for individuals who are at least 18 years of age. If you are a minor (under the age of 18), you may only use our services under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. By using the platform, you represent that you have the legal capacity to enter into this agreement.

3. User Accounts

To access certain features like courses or scribe assistance, you must create an account. You agree to provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your username and password.

Strict No-Sharing Rule: Your account is for your personal use only. Sharing your account credentials with others is strictly prohibited and is considered a material breach of these terms.

4. Services Provided

Divyaability Foundation provides a multi-functional ecosystem including, but not limited to:

Educational courses (both paid and free versions).
Scribe facilitation services for students with disabilities.
Donation portals for supporting our foundation's mission.
Community events, webinars, and workshops.
Issuance of digital certificates upon course completion.

5. Course Purchase Terms

All courses purchased on our platform are digital products. Access is granted immediately or within a reasonable timeframe following a successful payment. Because these are digital goods with instant access, all purchases are generally non-refundable. We encourage users to review course descriptions and trailers before making a purchase.

6. Instructor & Creator Terms

Individuals may apply to become Instructors on our platform. Approval is at the sole discretion of the Divyaability team.

Platform Fee: The Foundation retains a service fee of up to 30% on all course sales to cover hosting, marketing, and administrative costs.
Ownership: Creators retain ownership of their content but grant Divyaability Foundation a license to host, market, and distribute the content.
Quality Control: We reserve the right to remove any content that is outdated, inaccurate, or violates our community standards.

7. Payment Terms

We use Razorpay as our secure third-party payment processor. By making a payment, you agree to their terms of service as well. Prices are subject to change, and applicable taxes (such as GST) may be added at checkout. If you encounter any payment issues, please contact our support team immediately.

8. Scribe Service Disclaimer

Our Scribe Support service is a facilitation feature designed to connect students with volunteers.

Facilitation Only: We act as a bridge. We do not employ the scribes directly.
No Guarantees: We do not guarantee that a scribe will be available for every request, nor do we guarantee their performance, punctuality, or accuracy during an exam.
Liability: The Foundation is not liable for any academic loss, exam cancellation, or issues arising if a scribe fails to show up or perform as expected.

9. User Restrictions

When using our platform, you agree NOT to:

Record, download, or distribute course content without written permission.
Use fake identities or provide misleading information during registration.
Attempt to bypass security measures or hack into other users' accounts.
Use the platform for any illegal or unauthorized purpose.

10. Account Suspension & Termination

We reserve the right to suspend or permanently ban any account that violates these terms, including cases of fraud, account sharing, or abusive behavior. Termination can happen without prior notice, and in such cases, any remaining course access or balance will be forfeited without a refund.

11. Intellectual Property

The platform design, logo, graphics, and all original content are the exclusive property of Divyaability Foundation. Unauthorized use of our branding is strictly prohibited.

12. Platform Rights

We reserve the right to modify services, change pricing, or remove certain features at any time to ensure the sustainability and quality of the platform.

13. Third-Party Services

Our platform integrates with third parties like Razorpay, Google, and WhatsApp. We are not responsible for any downtime or data issues caused by these external services.

14. Limitation of Liability

Divyaability Foundation provides its services on an "as-is" and "as-available" basis. We do not guarantee 100% uptime. We are not liable for any direct or indirect damages, loss of data, or loss of profits arising from your use of the platform.

15. Indemnification

You agree to indemnify and hold Divyaability Foundation harmless from any claims, losses, or legal fees resulting from your violation of these terms or misuse of the platform.

16. Dispute Resolution

If you have a problem, please contact our support team first. We aim to resolve most issues through friendly communication. If a resolution cannot be reached, legal proceedings may follow.

17. Jurisdiction

These terms are governed by the laws of India. Any legal disputes shall be handled exclusively in the courts of Delhi, India.

18. Communication Consent

By creating an account, you agree to receive essential communications from us via email, WhatsApp, and SMS regarding your account, purchases, and platform updates.

19. Future Services

We are constantly growing. Future integrations may include API access, enhanced SMS services, and AI-driven support, which will be covered under these same terms.
