  • Financial Logs: Transaction IDs and payment statuses. Please note that we handle digital delivery of all paid content.
  • Technical & Analytics Tracking: We automatically collect data such as your IP address, device type, browser information, and cookies. We use this analytics data purely to understand platform performance and make the user experience better for everyone.
Sensitive Personal Data Protection: Because of the nature of our work, we collect sensitive documents like disability certificates, ID proofs (Aadhar/Voter ID), and PAN details for donation receipts. We treat this as Sensitive Personal Data or Information (SPDI). This data is handled with extreme confidentiality and used strictly for verification and service delivery. We never store your credit card or bank account numbers; all payments are processed through Razorpay’s secure, world-class infrastructure.

3. How We Use Your Data

Your data helps us serve you better. We use it to:

  • Manage your secure account and keep your learning dashboard updated.
  • Ensure the digital delivery of courses and the instant generation of certificates.
  • Effectively match students with scribes for exams and coordinate with volunteers.
  • Process donations and issue 80G tax-exempt receipts where applicable.
  • Send you important updates, newsletters, or respond to your support tickets.
  • Monitor the platform for security threats, fraud, or unauthorized usage.
  • Improve our website using internal analytics and user feedback loops.
  • Comply with legal mandates under the laws of India.

4. Third-Party Services & Data Storage

To keep the platform running 24/7, we work with a few trusted third-party partners. Your data may be stored on cloud servers managed by these providers, which might be located in different geographic regions depending on their infrastructure.

  • Razorpay: Handles all our payment processing securely.
  • Google: Used for secure "One-Tap" logins and website analytics.
  • Hostinger: Provides our web hosting and secure database storage.
  • PHPMailer/SMTP: Manages our automated email systems.

Third-Party Liability: While we only work with the best, these companies have their own privacy policies. Divyaability Foundation is not responsible for how these independent third parties manage data or for any security lapses on their end.

5. Data Security & Retention

We use strong SSL encryption and restricted access controls to keep your data safe. We keep your information as long as your account is active. If you choose to delete your account, we may still retain some data for a limited time to comply with legal, audit, or fraud-prevention requirements.

Data Breach Clause: No system is 100% impenetrable. In the unlikely event of a data breach, we will make reasonable efforts to notify you so you can take protective steps. However, the Foundation is not liable for data loss caused by sophisticated cyber-attacks, external hacking, or "Force Majeure" events (things beyond our human control).

Business Transfer: If Divyaability Foundation ever undergoes a merger, acquisition, or sale of assets, your user data may be transferred to the new entity so that your services can continue without interruption.

6. Account Security & User Responsibility

You are the first line of defense for your data. You are responsible for keeping your password and login details private. Any activity that happens under your account—whether authorized by you or not—is considered your responsibility. If you think someone else has your password, please change it immediately and let us know.

7. Account Sharing & Misuse Policy

To support our mission, we have a strict One Account, One User policy. When you purchase a course, you receive a personal license to learn.

  • No Sharing: Sharing your login credentials with others to "split" a course cost is strictly prohibited.
  • Tracking: We use IP tracking and device-based monitoring to detect if an account is being used by multiple people in different locations.
  • Consequences: If we detect suspicious activity, we reserve the right to temporarily suspend or permanently ban your account. In such cases, no refunds will be provided.

8. Content Protection

The courses, videos, and notes on this platform are our intellectual property. You are allowed to view them for personal learning, but you are not allowed to record, copy, download (unless permitted), distribute, or resell any part of the content. We take content theft very seriously and will pursue legal action against anyone found violating these rights.

9. Scribe Service Disclaimer

We take pride in helping students find scribes. However, please understand that we act only as a facilitator. We connect you with volunteers, but we cannot 100% guarantee a scribe's performance, accuracy, or punctuality. The final responsibility for ensuring the scribe meets exam board requirements rests with the user.

10. Payments & Refunds

Course Creator Rule: If you are a creator selling courses on our platform, a standard platform fee (up to 30%) applies to the revenue generated. These terms are governed by your specific instructor agreement.

11. Children’s Privacy

We care about younger learners. If you are under 18, you must use our platform only with the involvement and consent of a parent or legal guardian. We do not intentionally collect data from minors without guardian supervision.

12. Limitation of Liability

To the maximum extent allowed by law, Divyaability Foundation shall not be liable for any indirect or incidental damages resulting from the use or inability to use our services. We do not guarantee that the platform will always be error-free or uninterrupted, though we work very hard to make it so.

13. Jurisdiction & Essential Links

This policy is governed by the laws of India. Any legal disputes will be handled exclusively by the courts in Delhi, India.
